1. INTRODUCTION

These Terms and Conditions govern the use of the NCnet online store and the purchase of products through the online store.

By accessing, browsing or purchasing products through the NCnet online store, you acknowledge that you have read, understood and agreed to be bound by these Terms and Conditions.

If you do not agree with these Terms and Conditions, please do not use the online store or place an order.

NCnet CC reserves the right to amend these Terms and Conditions from time to time. Any updated Terms and Conditions will be published on the online store and will apply from the date of publication, subject to applicable law.

2. DEFINITIONS

For purposes of these Terms and Conditions:

6. PRODUCT PRICES

All prices displayed on the online store will be stated in South African Rand (ZAR) unless otherwise indicated.

7. PLACING AN ORDER

To place an order, the customer must:

  1. Select the desired product.
  2. Add the product to the shopping cart.
  3. Provide the required customer and delivery information.
  4. Select an available payment method.
  5. Review the order details.
  6. Confirm the order and make payment where required.

Before submitting an order, the customer is responsible for checking that the products, quantities, delivery address and other order information are correct.

8. ACCEPTANCE OF ORDERS

Submitting an order does not necessarily mean that NCnet has accepted the order.

NCnet may accept or decline an order subject to product availability, payment verification and other legitimate operational requirements.

An order will be regarded as accepted when NCnet confirms acceptance of the order electronically or otherwise communicates acceptance to the customer.

Where NCnet is unable to fulfil an order, the customer will be notified and any payment received for the unfulfilled order will be refunded where applicable.

9. PAYMENT

Payment may be made using the payment methods displayed on the online store.

NCnet may use third-party payment service providers to process payments.

Customers agree to provide accurate and valid payment information.

NCnet does not intentionally retain complete payment-card information where payment processing is handled by a third-party payment provider.

An order will generally only be processed once payment has been successfully authorised or otherwise confirmed.

10. DELIVERY

NCnet will deliver products to the delivery address provided by the customer during checkout.

Delivery charges, estimated delivery periods and available delivery areas will be displayed on the online store or otherwise communicated to the customer before the order is finalised.

Delivery times may vary depending on:

  • Product availability.
  • Delivery location.
  • Courier availability.
  • Public holidays.
  • Weather or other circumstances beyond NCnet’s reasonable control.

NCnet will take reasonable steps to meet the estimated delivery period.

Where a specific delivery date has been agreed, NCnet will endeavour to deliver on that date.

The customer is responsible for providing an accurate and complete delivery address and ensuring that someone is available to receive the order where required.

11. RISK AND DELIVERY

Where applicable, NCnet will remain responsible for the goods until the customer has accepted delivery, subject to applicable law.

Customers should inspect delivered products within a reasonable period and notify NCnet promptly of any visible damage, missing items or incorrect products.

12. RETURNS, EXCHANGES AND REFUNDS

Returns, exchanges and refunds are governed by NCnet’s Returns & Refund Policy, which forms part of these Terms and Conditions.

Nothing in the Returns & Refund Policy or these Terms and Conditions is intended to remove or limit any mandatory rights available to consumers under South African law.

Where a product is defective, unsafe, unsuitable or otherwise fails to comply with applicable legal requirements, the customer may have statutory rights to a repair, replacement or refund.

13. ONLINE PURCHASE CANCELLATION RIGHTS

Where applicable, customers may have statutory cancellation rights in respect of electronic or direct-marketing transactions.

NCnet will comply with applicable cancellation and cooling-off requirements under South African law.

Any statutory right to cancel, return or obtain a refund will not be excluded by these Terms and Conditions.

14. WARRANTIES AND DEFECTIVE PRODUCTS

NCnet will honour applicable manufacturer warranties and statutory consumer rights.

Where a product is defective or does not meet applicable legal standards, the customer should contact NCnet as soon as reasonably possible and provide the relevant order or proof-of-purchase information.

NCnet may require reasonable information, photographs or other evidence to assess the reported defect.

Nothing in these Terms and Conditions limits rights that cannot lawfully be excluded under the Consumer Protection Act.

15. INTELLECTUAL PROPERTY

All intellectual property appearing on or forming part of the NCnet online store, including:

  • Logos;
  • Trademarks;
  • Business names;
  • Product descriptions;
  • Photographs;
  • Graphics;
  • Website design;
  • Text;
  • Software; and
  • Other original content

belongs to NCnet or its respective licensors, unless otherwise stated.

No content may be reproduced, distributed, modified or commercially exploited without the prior written consent of the relevant rights holder, except where permitted by law.

16. CUSTOMER ACCOUNTS

Where the online store provides customer-account functionality, customers are responsible for maintaining the confidentiality of their login credentials.

Customers must notify NCnet if they suspect that their account has been accessed without authorisation.

NCnet may suspend or terminate an account where there is reasonable evidence of fraud, misuse, security risks or violation of these Terms and Conditions.

17. PERSONAL INFORMATION AND PRIVACY

NCnet will process customer personal information in accordance with applicable South African privacy legislation, including the Protection of Personal Information Act 4 of 2013 (POPIA).

Personal information may be collected and processed for purposes including:

  • Processing orders.
  • Processing payments.
  • Delivering products.
  • Communicating with customers.
  • Providing customer support.
  • Processing returns and refunds.
  • Preventing fraud and abuse.
  • Meeting legal and regulatory obligations.
  • Improving NCnet’s products and services.

NCnet will remain responsible for its obligations to customers to the extent required by applicable law.

21. LIMITATION OF LIABILITY

To the maximum extent permitted by law, NCnet will not be liable for indirect, incidental or consequential loss arising from the use of the online store.

However, nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

Nothing in these Terms and Conditions limits a customer’s rights under the Consumer Protection Act, the Electronic Communications and Transactions Act, the Protection of Personal Information Act or any other applicable legislation.

22. FORCE MAJEURE

NCnet will not be responsible for delays or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control.

Such circumstances may include, but are not limited to:

  • Natural disasters.
  • Fire or flooding.
  • Power failures.
  • Internet or telecommunications failures.
  • Strikes or industrial action.
  • Government restrictions.
  • Civil unrest.
  • Epidemics or pandemics.
  • Transport or courier disruptions.
  • Cybersecurity incidents.
  • Acts of war or terrorism.

NCnet will take reasonable steps to minimise the effect of such circumstances.

23. CUSTOMER COMPLAINTS

Customers who have a complaint should first contact NCnet using the customer-service details published on the online store.

A complaint should include:

  • Customer’s name.
  • Order number.
  • Contact details.
  • Description of the complaint.
  • Relevant supporting documents or photographs.

NCnet will make reasonable efforts to investigate and resolve complaints promptly.

24. FRAUD AND SUSPICIOUS TRANSACTIONS

NCnet reserves the right to verify transactions and take reasonable measures to prevent fraud.

Where a transaction appears fraudulent or unauthorised, NCnet may delay, suspend or cancel the transaction and contact the customer or relevant payment provider for verification, subject to applicable law.

25. REVIEWS AND CUSTOMER CONTENT

Where the online store allows customers to submit reviews, comments, photographs or other content, customers must ensure that their submissions:

  • Are truthful and based on their genuine experience.
  • Do not contain unlawful, defamatory, threatening or abusive material.
  • Do not infringe another person’s intellectual-property or privacy rights.
  • Do not contain malicious software or harmful material.

NCnet may remove content that violates these requirements or applicable law.

26. LINKS TO THIRD-PARTY WEBSITES

The online store may contain links to third-party websites.

NCnet is not responsible for the content, security, availability or privacy practices of third-party websites.

Customers access third-party websites at their own risk and should review the applicable terms and privacy policies.

27. CHANGES TO PRODUCTS AND SERVICES

NCnet may update, modify, discontinue or replace products and services offered through the online store.

Such changes will not affect an order that has already been accepted except where permitted by law.

28. CHANGES TO THESE TERMS

NCnet may update these Terms and Conditions from time to time.

The latest version will be published on the online store.

Where an amendment materially affects an existing customer agreement, NCnet will comply with any applicable legal requirements concerning notice and consent.

29. GOVERNING LAW

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any dispute arising from the use of the online store or a transaction with NCnet will be dealt with in accordance with applicable South African law and the appropriate dispute-resolution procedures.

Nothing in these Terms and Conditions prevents a consumer from exercising any statutory rights or remedies available under South African law.

30. SEVERABILITY

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision will be severed or modified to the extent necessary, and the remaining provisions will continue to apply.

31. ENTIRE AGREEMENT

These Terms and Conditions, together with the NCnet Returns & Refund Policy, Privacy Policy and any other policies expressly incorporated into the online store, constitute the terms governing the customer’s use of the online store and purchase of products from NCnet, subject to applicable law.
